If you know who was at fault in your accident, you may be able to contact them directly about the matter. If the accident and injury is only minor, you might be able to negotiate a settlement between yourselves. This is because you cannot make a legal claim for very minor injuries – the injuries must meet a compensable minimum amount. For example, bruises or minor scrapes will not usually give rise to a personal injury claim for compensation, however you may find that the person who caused the incident is willing to offer you some money for your suffering, inconvenience and loss of income. If your injury is anything other than very minor, you should seek legal advice from a personal injury claim solicitor. Legal aid is no longer available for personal injury claims. You may be able to get some assistance from your local law centre. However, the usual course of action is to consult a personal injury claim solicitor. You may choose to fund them in the normal hourly billing way or you may seek a no-win, no-fee personal injury claim solicitor. Just because you have a personal injury solicitor representing you does not necessarily mean your matter will end up in court. If you would prefer to try to settle the matter out of court you can let your personal injury claim solicitor know. In some cases, mediation is a suitable and beneficial option for coming to a resolution of the situation. Or, the legal representatives for each side might correspond with each until they reach an agreement. If you reach a settlement agreement, it is absolutely essential that you get legal advice from a personal injury claim solicitor before signing anything. Once you have signed the settlement agreement you have waived your legal rights and may no longer be able to take the matter to court if it turns out the amount settled for is inadequate.
