Does drink driving carry a prison sentence?

If you have been charged with any drink driving offence, irrespective of the seriousness of the offence, you should seek legal advice and contact a criminal law solicitor. A solicitor will be able to advise you on whether or not you are likely to face a prison sentence if convicted of the offence for which you have been charged.

In the lesser serious drink driving cases, it is often possible to avoid a prison sentence. If you instruct a solicitor, they may be in a position to plead mitigation in your case. Mitigation, or mitigating factors, if accepted by the court, will help to reduce the severity of your punishment. In driving related offences mitigating factors include:

- a good driving record
- the absence of previous convictions
- a timely plea of guilty;
- genuine remorse or shock (which may be greater if the victim is either a close relation or a friend)
- the offender's age (but only in cases where lack of driving experience has contributed to the commission of the offence)
- the fact that the offender has also been seriously injured as a result of the accident caused by the dangerous driving
If there are aggravating factors, these are factors which if present, will make the seriousness of the offence worse and warrant a more severe punishment. Driving whilst under the influence of alcohol is an aggravating factor. However, if you instruct a solicitor they may be able to counter these aggravating factors or provide a reason for why they were present.
