If you are stopped by the police and are over the drink driving legal alcohol limit then you should take legal advice from a criminal solicitor. The law allows the police to stop you if they suspect you have been drinking. This might be the case if you have been to the pub, have been out for dinner, or if you are behaving or acting as though you may have had a drink. If you are over the limit you will be arrested and taken to the station to be further tested and charged. Further testing will be either with urine, or blood, but blood can only be taken by a doctor. You are entitled to refuse to give a sample but if you do so you may be convicted of the offence as charged. The penalty incurred may be worse as you failed to cooperate. Your criminal solicitor can advise you on the best course of action to ensure you receive the most favourable outcome. The maximum penalty for drink driving offences is 6 months in prison, a £5000 fine and a ban from driving for between 12 and 36 months. The maximum penalty for being in charge of a vehicle is a £2500 fine, up to 3 months in prison and a ban. In most cases a first offence is punished with a 12 month ban and a fine. It is possible in highly exceptional circumstance to avoid a ban. Your criminal solicitor can advise you on situations where this may be the case.
