Drink driving limits under the law

By: Maksiv Konta

The legal alcohol limit in the UK is 35 micrograms of alcohol per 100 ml of breath, or 80 milligrams of alcohol per 100 ml of blood. If you test positive at the road side then you will be arrested, and asked to submit a further sample at the police station. Only a medical professional can take the blood sample.

It is possible to interpret the amount of alcohol drunk to your blood alcohol level. Such estimations should be used with caution as the effect alcohol can have will vary from individual to individual based on a wide range of factors including age, size and tolerance.

The police can stop you if you are driving and they suspect you may have had a drink. They can also stop you on your way to your vehicle, whilst attempting to gain entry, or even if you are in the vehicle without the engine running. This offence is known as being in charge of a vehicle whilst over the legal alcohol limit. The maximum penalty for being in charge of a vehicle is 3 months in prison, a £2500 fine and a ban from driving of between 12 and 36 months. The punishments for driving drunk are more serious, and can be as much as 6 months in prison and a £5000 fine.

Your criminal solicitor can offer legal advice on mitigating factors which might affect your case. It is possible to avoid a ban in some very exceptional circumstances.
