This is obviously subject to some interpretation but can be used in situations where you are found asleep in your car with the keys in the ignition. If you have committed a drink driving offence you should take legal advice from a criminal solicitor immediately. Drink driving offences in the UK are deemed very serious. As a result it is possible for a court to impose a prison sentence in some situations. The maximum prison sentence for driving whilst over the legal alcohol limit is 6 months. The maximum is reduced to 3 months for the offence of being in charge. Many drink driving offences, especially in the first instance, do not attract a prison sentence. Instead you are likely to be banned from driving for between 12 and 36 months at the courts discretion. It is possible in very exceptional circumstances to avoid a ban. Your criminal solicitor can advise you on this and will help you prepare a case aimed at avoiding such a ban where it will severely impact on your livelihood and ability to support your family. In addition to a lengthy ban, most sentences will carry a fine. The maximum fine for driving over the legal alcohol limit is £5000. The maximum fine for being in charge is £2500. It is possible to reduce the length of the ban and size of the fine by attending a drink driving rehabilitation course if such a course is offered by the court. Your criminal solicitor can advise you on when this is likely to be offered.
