Both personal injury claim companies and personal injury solicitors will normally try to negotiate a settlement of your claim out of court. However, there is a concern that claims management companies may have a great incentive to settle your claim out of court and therefore may encourage you to accept a settlement lower than the amount you deserve. At the same time, settling out of court does save a considerable amount in legal fees, barristers' fees, experts' fees and court fees. Not only that, settling out of court saves you the time and stress of drawn out legal proceedings and adversarial litigation. On the other hand, there is a concern that personal injury solicitors may have an incentive to litigate your personal injury claim to the end, to maximise the legal costs payable to them. Thus, there are views on each side. What is important is that, before you accept any settlement of sign a contract with a claims management company, you get legal advice from a personal injury solicitor. Whilst claims management companies may advertise their services as being much cheaper than using a personal injury solicitor, in reality you can use a no-win, no-fee personal injury solicitor for the same low cost, as you do not have to pay their legal fees unless you win your case and even then they are normally paid by the losing party. Further, claims management companies are a middle man and thus, if you are going to need legal advice from a personal injury solicitor at some point, you may as well go straight to a personal injury solicitor.
