Is it free to use a no-win, no-fee lawyer?

The first step to making a claim is to find a solicitor willing to work on a no win, no fee basis. There are several options, and whilst some may charge you for an initial consultation, many will not. The consultation aims to establish the facts of your case, dates, times, and people involved. It helps to have available a detailed written account with the names of any relevant witnesses to hand. Photographic evidence may also be useful but this will be something you can discuss with your no-win, no-fee solicitor at the consultation.
Your no-win, no-fee solicitor will decide if they believe you have a case, and if you do will outline the level of compensation you may be able to expect. If you decide to instruct them, then the next stage is to write a letter to the defendant outlining your case. It is possible that you may be asked to pay for the cost of any disbursements, which might include obtaining a professional opinion to back up your case, in general though these costs can be covered by insurance.
Your no-win, no-fee solicitor can advise on whether to accept any offers which are made by the defendant. Should your case go all the way to court, the advantage of the no-win, no-fee basis is that your solicitor’s fees are covered by insurance in the event that your case is unsuccessful. If you are successful, then the defendant is ordered to pay your legal fees as well as their own. As a result, in many cases you are able to claim the full amount of compensation awarded with no deductions.
