If your business trades outside of the UK with what are called Third Countries, international trade laws will be your business’s primary focus, as your commercial partners or customers are outside of the EU. There could also be issues if you are moving goods that cross EU Member States’ territory before your consignments reach their final destination in a Third Country. Legal advice and assistance from an international trade solicitor will be vital to your business. It is also important to note that European and international trade laws are in addition to the national laws of all countries. Organisations like the UN (United Nations) and WTO (World Trade Organisation) may legislate on an international scale, but they must also take into consideration the domestic trading laws of each country concerned. Not all countries have agreements with the WTO, or have signed up for Regional Trade Agreements (RTA), as many European countries have. Your business should ensure it understands the regulatory regime that each country it trades with uses, and if indeed any of the conventions enacted by organisations like the WTO or the UN are actually recognised, and therefore, enforceable through the courts. An international trade solicitor can be of great assistance in this area and therefore it is highly advisable that your business consult with one.
