Which do I need to worry about: European trade laws or international trade laws?

The countries that you are trading with will determine the laws you need to consider. You are likely to need to consider the domestic law of the individual countries, European, and international trade law. You will also need to pay attention to the law where goods might stop over. As a general rule, you shouldn’t need to worry about a great deal if you instruct experienced international trade solicitors to deal with your case.

International trade solicitors will help by drafting comprehensive and tight contracts which deal with most eventualities. The contracts will specify the jurisdiction where disputes will be settled, should they occur, and will specify which country’s domestic law applies to the contract. Where you are only trading within Europe, your international trade solicitor will be able to advise on which laws have been harmonised under European trade law and which laws differ from member state to member state. If you are dealing with the trade of products, then you will certainly need to consider European standards which exist for a wide range of products, from electrical goods to toys.

International trade laws are applicable in all countries party to the relevant trade agreements. If you are unsure of which countries are bound by them, check with an international trade solicitor. In some circumstances, even where a country isn’t party to the relevant agreement, they can still be bound by its contents. International and European trade law are complex areas of law, and therefore it is highly advisable that you seek legal advice from international trade solicitors when trading overseas.
